In the trial for the murder of Cristian Maximiliano Díaz, medical experts have diagnosed "Pity" Álvarez with a "primitive brain" resulting from chronic drug use, while his defense challenges the validity of the proceedings given his mental state. The court heard that cocaine use can cause 'necrosis of the frontal lobe,' impairing sociability and inhibitory control .
Forensic psychiatrist Carlos De Marco stated that Álvarez has a pre-existing disorder aggravated by crack, cocaine, and alcohol consumption. He explained that under paranoid ideation, "psychic reality surpasses material reality," and it is "possible that consciousness was nullified" during the incident, with Álvarez feeling he was defending himself . Psychologist Daiana Sinigoj, who evaluated the musician in 2022, described a "marked affective indifference" and noted that Álvarez could not bathe alone or perform basic tasks without assistance .
Defense attorney Germán Francone argued there is a "total lack of congruence" in judging a person who is allegedly incapable. He emphasized that Álvarez is under "forced psychiatric hospitalization ordered by civil justice for being considered dangerous" . The defense has filed three appeals with the Superior Court regarding his mental fitness .
The trial, which began on August 10, has entered its final stage with 34 witnesses heard so far . Álvarez has been hospitalized since October 2 at the Solar Colonial clinic in Castelar and follows proceedings via Zoom . The next hearing is scheduled for Monday, when Álvarez is expected to testify and provide names of potential witnesses .
