In the fourth hearing of the trial against Cristian "Pity" Álvarez for the murder of Cristian Maximiliano Díaz, the Oral Criminal Court No. 29 rejected the requests of his new defense to suspend the proceedings, hold a jury trial, and reassess the musician's mental capacity. The court's decision marks a setback for the defense, which argues that Álvarez is not fit to stand trial due to cognitive deterioration. The court ruled that the issue of his fitness had already been resolved before the trial began.
The hearing, scheduled for 10:30 AM, began nearly an hour late as Álvarez arrived past 11 AM with his sister and lawyer Sebastián Queijeiro. During the session, Álvarez fell asleep and began snoring while his lawyer presented arguments, prompting the court president, Gustavo Goerner, to warn that he could leave and be represented by his attorneys. "We will not continue under these conditions," Goerner said.
The defense, led by Javier Baños and Queijeiro, presented a 31-page psychiatric report and requested new neuropsychological evaluations, including an MRI. They argued that Álvarez lacks the cognitive capacity to understand the proceedings. Prosecutor Sandro Abraldes countered, stating, "It is clear that 'Pity' and his defense do not want this trial," and accused them of staging a "show."
The court rejected all defense motions, including the request for a jury trial and the suspension of the process pending an appeal. The trial will continue with testimony from four witnesses.
