Actress Maribel Guardia has firmly denied seeking custody of her grandson, José Julián, directly contradicting claims made by the legal team of his mother, Imelda Tuñón. The dispute, which began after the death of Guardia’s son, Julián Figueroa, has escalated into a complex legal battle involving over 20 open procedures in family, civil, and criminal courts.
Antonio Lozano Gracia, representing Imelda Tuñón, asserted that Guardia filed consecutive appeals, complaints, and three amparo trials to remove custody from Tuñón. He highlighted a contradiction between Guardia’s public statements and court records, noting that on March 3, 2025, a proposal for supervised visits was formally rejected by Guardia in the Sixth Family Court. Lozano Gracia argued that these active resources prove an intent to separate the child from his mother.
Guardia responded with frustration, stating she is "exhausted" by the controversy. In a media encounter, she declared, "I do not want custody of José Julián, I have never wanted it." She emphasized that she loves the child deeply but suspended visitation requests to protect herself from what she described as fabricated criminal imputations. Her lawyer, Alfonso Beceiro, alleged that Tuñón’s side submitted a private psychological report to accuse Guardia and her husband, Marco Chacón, of physical and verbal aggression during visits. Beceiro claimed this was a tactic to force the eight-year-old to testify against them.
The conflict intensified on October 2, when a judge imposed restrictions on Guardia’s access. While Tuñón’s lawyers insist the legal process must proceed regardless of public denials, Guardia has called for privacy, describing the situation as a painful "soap opera" reality. Both sides remain entrenched in their respective legal strategies, with no resolution in sight.
