The National Basketball Association (NBA) has named Kalshi and Polymarket as its preferred prediction market exchanges and signed an information-sharing agreement with the U.S. Commodity Futures Trading Commission (CFTC) to protect market integrity. This move makes the NBA the third major U.S. sports league to embrace prediction markets, following the NHL and MLB, while the NFL has declined to participate.
Under the agreements, Kalshi and Polymarket gain access to official NBA data via Sportradar for settling authorized markets, along with rights to use NBA intellectual property and conduct promotional activities. The partnerships include integrity safeguards that prohibit NBA and team personnel from trading NBA event contracts and require cooperation on suspicious trading investigations. The NBA also expanded its existing agreement with DraftKings to cover prediction markets.
The CFTC agreement aims to strengthen information sharing to address insider trading and fraud. However, prediction markets face legal challenges from states arguing that event contracts constitute sports betting and should be regulated at the state level, while platforms and the CFTC contend they are derivatives under federal oversight. Courts have delivered conflicting rulings, with the 6th Circuit ruling against Kalshi in a case involving Ohio and Tennessee, while the 3rd Circuit allowed Kalshi to operate in New Jersey. The U.S. Supreme Court has been asked to review the New Jersey dispute, with 39 states and Washington, D.C., supporting the petition.
